Workers Comp Law Is A Powerful Group Of Laws

A laborer who is involved in an accident that takes off his arm while he's on a job will receive the maximum benefits available from worker's compensation. New York law provides payments to the worker of $400 per week for a maximum of 312 weeks. However, if another worker hurts his lower back at work and suffers from continual pain, according to the law he can receive weekly compensation payments for the duration of his life.

The reason for this type of discrepancy traces back to a 1914 law created to manage worker's compensation. Not all injuries resulting from accidents are covered under the law, but many are bound by a schedule.

This regulation designates the amount of benefits given for the loss of hearing or for a body part. However, when it comes to partial and different permanent disabilities that have no mention in any regulations, all profits are disbursed for a lifetime. Some of the injuries included in this category are mental stress and back pain, a common occurrence in many workers compensation claims.

Because of this oversight, just 13% of workers compensation claims receive 70% of the payments made. Premier workers comp in New York is 72% over the national average. The result is that tax dollars are pulled away from other services such as schools and government entities in order to be paid to workers compensation claims.

At the other end of the system, the maximum workers compensation benefit of $400 per week is now lagging behind other states in the region. On a positive note, local governments of New York have already begun to address both sides of the equation. Other states across the country have increased their maximum from $400 a week upwards to $685 a week.

Texas, previously had one of the worst workers? compensation systems in the nation. Since then, Texas made alteration to the system they used. Texas has more injured workers than any other state, and the 3rd most expensive cost for workers comp coverage.

There was also a large problem with doctors dropping out of the program at an alarming rate. Texas solved their worker's compensation problem by building new physician networks and making a small increase in the benefits available to injured workers. The revamped structure now in operation in Texas stands out as a great example for the rest of the United States.

Suggestions for overhauling New York's workers comp have included limiting to ten years the benefits provided for permanent partial disability. Law makers are also considering raising the maximum weekly benefit to $500. These modifications would make it easier to eliminate premier fees by as much as 15%.

New York remains hopeful that additional ideas and proposals will be observed by the government which can help to increase these benefits every more. If the goal is to solve the problems with worker's compensation benefits, the the best choice is a mutual agreement on a increasing benefits. It will also eliminate those endless payments to back pain sufferers.

The State of California has already implemented such reforms within its compensation laws. In that state, a petition drive was launched to put the question on the ballot. The deluge of support for this petition forced the legislature to move on reform.

Without using the option of a petition drive, the best bet to achieve any reform for New York will be convincing their legislative leaders to make sure this problem is moved to the front burner immediately. It's critical for legislators in many areas to inform their leaders that many businesses and local governments are struggling because of these unresolved issues.
