Workers' Compensation Insurance

Two things that all people involved in workers' compensation agree on are that the system has many problems and someone else deserves the blame. Employees, employers, and insurance companies are accused of fraud. The California Department of Insurance puts the blame on company bosses.

One of the fastest growing areas of workers' compensation insurance is employer fraud. An employer can commit fraud by underreporting the payroll or by misclassifying employees. The state's top insurance regulator sees this from a different angle. According to the insurance commissioner of California, employers pay large amounts of money to employees who abuse workers' compensation insurance.

An attorney who deals with issues regarding workers' compensation does not absolve groups involved from blame for the current crisis. His strongest defense is reserved for the workers. The number of fraud incidents by workers is small. The California applicants' attorneys association reveals in its Web site that a small number of arrests were made out of the 4 million injuries reported from 1993 to 1998.

It is his wish that employers and employees come to the realization that they are both in the same situation. The cost of insurance dropped five years after the deregulation of the insurance industry in 1995. Because there were very little claims made, the insurance companies invested in the runaway stock market and made huge profits.

Problems also came about because of 9/11. Billion dollar losses and many companies out of business were the results of these terrorist attacks. Any legislation that is proposed to make the 235 private insurance companies that offer workers' compensation coverage appear on the Web site gets his vote.

Another point of disagreement is that when there's a claim, prices rise, and when there's no claim, prices stay as they are. Senate Bill 191 which aims to reward claim free employees is a legislation he supports.

This physical therapist describes his patients' conditions as compitis. He believes that there is a notable difference in the recovery time of a work related injury when compared to the recovery time for a non related work injury.

A person who got injured because of a mishap at work would most likely take longer to recover than if he got injured because of an accident outside of work. He said the streamlined system of payment also encourages doctors, physical therapists and other health care providers to keep workers' compensation patients on their books.

Once the paperwork is done, health professionals will get their payment in the form of a check by return post. This is very different from the inconvenience one would usually experience with an HMO, which uses a time consuming, expensive, and difficult system.

A chiropractor mentions that only 15% of his patients are on workers' compensation, but in the case of other chiropractors, the figure is 40%. To take advantage of what they can get from the system, some chiropractors would make use of services, therapies, and machines they don't normally use. He is no stranger to how patients abuse the system. Tests will determine who among a doctor's patients is just faking an injury.
